Many states have enacted laws against AI-generated child sexual abuse material (CSAM), but these may conflict with the Ashcroft ruling. The difficulty in distinguishing real from fake images due to AI advancements may necessitate new legal approaches to protect minors effectively. Child pornography, now called child sexual abuse material or CSAM is not a victimless crime. Sometimes, people put child sexual abuse material in a different category than child sexual abuse. Someone might rationalize it by saying “the children are participating willingly,” but these images and videos depicting children in sexual poses or participating in sexual behaviors is child sexual abuse caught on camera, and therefore the images are illegal. Some refer to them as “crime scene photos” since the act of photographing the child in this way is criminal.
- It is important that youth know that they have the ability to say NO to anything that makes them uncomfortable or is unsafe.
- If you are having difficulty setting or enforcing boundaries between children, you should seek specialized help.
- In the backgrounds, analysts saw soft toys, games, books and bedding featuring cartoon characters.
- All ‘self-generated’ child sexual abuse imagery is horrific, and our analysts sadly see it every day, but seeing so many very young children in these images and videos is particularly distressing.
Illegal pornography
Some of this material is self-generated but what happens when the device needs to go for repairs? We took a closer look at a small sample of these images to further investigate the activity seen. We sampled 202 images and videos; 130 images were of a single child and 72 contained multiple children. Rates of child sexual abuse have declined substantially since the mid-1990s, a time period that corresponds to the spread of CP online. The fact that this trend is revealed in multiple sources tends to undermine arguments that it is because of reduced reporting or changes in investigatory or statistical procedures. To date, there has not been a spike in the rate of child sexual abuse that corresponds with the apparent expansion of online CP.

This situation shows the vulnerability of children to become victims of networks of pornographic criminals who make huge profits from their innocence. While child porn children grow up, it is quite normal for there to be an element of sexual experimentation and body-curiosity; that is not what we find in these ‘self-generated’ images and videos of child sexual abuse. To be clear, the term ‘self-generated’ does not mean that the child is instigating the creation of this sexual content themselves, instead they are being groomed, coerced and in some cases blackmailed into engaging in sexual behaviour. In cases involving “deepfakes,” when a real child’s photo has been digitally altered to make them sexually explicit, the Justice Department is bringing charges under the federal “child pornography” law. In one case, a North Carolina child psychiatrist who used an AI application to digitally “undress” girls posing on the first day of school in a decades-old photo shared on Facebook was convicted of federal charges last year. The prosecutions come as child advocates are urgently working to curb the misuse of technology to prevent a flood of disturbing images officials fear could make it harder to rescue real victims. Law enforcement officials worry investigators will waste time and resources trying to identify and track down exploited children who don’t really exist. To be considered child sexual abuse there does not have to be penetration to the vagina or anus. It is a common misunderstanding that so long as there has been no penetration, we don’t have to worry too much. Yet, to be considered child sexual abuse, behaviors do not have to involve penetration to the vagina, anus, or mouth (by penis, tongue, finger or object), or involve force.
“This is the first generation ever – it’s like a gigantic historical experiment where we’ve given our children access to anything. But more importantly, perhaps, we’ve given anything access to our children.” “If you’ve got a social-media site that allows 13-pluses on, then they should not be able to see pornography on it.” Senior military figures and nuclear scientists were among those killed, Iranian state media reported. “In 2019 there were around a dozen children known to be missing being linked with content on OnlyFans,” says its vice president, Staca Shehan.
